Shinsei Servicing Company (Shinsei Servicer) highly values the personal information shared with us by borrowers, clients and investors, and we remain committed to protecting this data in our role as a servicer. Our internal compliance efforts have received consistently high assessments from leading international rating agencies, and we consider it imperative to maintain this high standing and to remain fully compliant with Japan's Personal Information Protection Law (Law No. 57 of 2003) and related laws as we continue to work proactively to strengthen our compliance program and safely manage your personal information.

We have established the following policy, an essential aspect of our Code of Conduct, to ensure the utmost protection of personal information.

Collection, Use and Disclosure of Personal Information

Shinsei Servicer will obtain personal information to a necessary degree for achieving the following objectives related to the fair and appropriate conduct of business:

  • Management and collection of specified monetary claims
  • Administrative affairs as an agent for securitization structures
  • Management affairs as an agent for special purpose companies (SPCs)
  • Administrative affairs for debt management
  • Consulting
  • Administrative affairs upon completion of lease claims and other management and collection operations
  • Personnel affairs

Shinsei Servicer handles the following types of personal information concerning individual borrowers, guarantors and other persons:

  • Basic personal information of the concerned individual(s): Name, address, phone number, date of birth, occupation and gender
  • Information concerning objectives of use: Loan originator, current borrower, loan date, loan amount, loan interest rate, liability interest rate, debt type, repayment deadline, assets, liabilities, debt balance, repayment record, collateral, guarantee, bank account, negotiation records, legal procedure records, record of obtaining/returning debt certificate, etc.

This personal information is used and provided to a third party only within the scope agreed to by the individual concerned. Additionally, Shinsei Servicer has established procedures and staff dedicated to handling requests by concerned individuals for disclosure of certain matters concerning their personal information, including notification of objectives for using personal information, personal information disclosure reports and notification of corrections to or suspension of use of personal information. Security and Accuracy of Personal Information

Shinsei Servicer applies a comprehensive approach to ensure that personal information remains protected, and maintains the highest level of accuracy possible through organizational, physical and technological security measures. Roles and responsibilities regarding organizational security measures are strictly defined, and regular employee training and monitoring is conducted to ensure the effective understanding and implementation of personal information protection efforts throughout the organization. Shinsei Servicer offices, located in Shinsei Bank's head office building in downtown Tokyo, are protected by an advanced security system as well as multiple security levels throughout the building to prevent physical theft. Shinsei Servicer also enforces general rules of use for its information system as well as state-of-the-art technology to ensure that personal information is also digitally protected from cyber thieves.

Compliance Program

Shinsei Servicer's highly appraised compliance program was established to realize the protection and appropriate management of personal information. Our compliance program plays a central role in everyday operations, and we prioritize employee understanding and cooperation with the program through continual training and monitoring initiatives.
