Basic Policy for Personal Information Protection (Privacy Policy)

The Shinsei Servicing Company is committed to complying with the Personal Information Protection Law (2003 Law No. 57) and related laws by taking steps to protect personal data possessed by the Company on debtors, etc. in the Company's role as a debt servicer. The following policy has been established to ensure utmost protection of personal information and to show our commitment by making the above information protection a philosophy that is an essential aspect of our Code of Conduct.

1. Appropriate acquisition of personal information
Personal information shall be obtained to a necessary degree for achieving objectives according to suitable and fair methods such as after designation of clear use objectives within the business scope.

2. Use and provision of personal information
Personal information shall be used and provided to a third party only within the scope agreed by the party that information is about.

3. Securing the security and accuracy of personal information
Organizational, physical and technological security measures shall be constructed and the following measures shall be implemented to secure the security and accuracy of personal information.
(1) The organizational security measures shall consist of the establishing and monitoring of rules for monitoring employees and managing security after the roles and responsibilities in information management have been clarified.
(2) Physical security measures shall be implemented that prevent the theft and loss of information.
(3) Technological security measures shall consist of systematic use principles that are established to manage accuracy and security.

4. Disclosure of personal information
As for the use of personal information, the following matters shall be disclosed to ensure they can be known by the party the information concerns when said party requests such.
(1) Use objectives and items of possessed personal data
(2) Procedures for disclosing possessed personal information
(3) Offices and contacts handling claims, corrections, additions, deletions, use suspension and the suspension of provision to third parties

5. Implementation of the compliance program
A compliance program shall be established to realize the protection and appropriate management of personal information and steps shall be taken to spread and ensure compliance of the program among employees by conducting education, training and monitoring. The concerned program shall be periodically revised to satisfy the social environment, revisions to the law and other developments.

The following are the procedures based on the Personal Information Protection Law.

Handled personal information items
The following are the personal information items concerning personal debtors, guarantors, etc. that are handled by the Company.

  1. Basic personal information of the concerned individual
    Name, address, phone number, date of birth, occupation and gender
  2. Information on use objectives
    Original debtor, present debtor, loan date, loan amount, loan interest rate, liability interest rate, debt type, repayment deadline, assets, liabilities, debt balance, repayment record, collateral, guarantee, bank account, negotiation records, legal procedure records, record of obtaining/returning debt certificate, etc.

Methods for requesting notification of use objective
The following procedure can be followed to request notification of the use objectives for personal information items handled by the Company.

  1. Please contact the following desks when requesting use objectives. The Company shall send a Personal Information Use Objective Notice Request to the address registered with the Company for the individual on whom the information concerns after the Company asks, for identity confirmation purposes, for the name, address, etc. of the individual on whom the information concerns and the individual making the request of the use objective notice. When contacting the Company's offices, please have the received notice on hand if we have mailed such to you.

  2. Fill out the necessary items on the Personal Information Use Objective Notice Request that we send you and mail it back to the Company in the enclosed envelope. We shall then mail the Personal Information Use Objective Notice to you at a later date.

Fees
A fee of 1,050 yen (including consumption tax) per request shall be incurred for a use objective notice. Therefore, the Company shall enclose the use objective notice request fee invoice with the Personal Information Use Objective Notice Request or send it separately. Please make sure to deposit the funds. The said request fee must be paid in advance.

Notes of Precaution

  1. Please understand that the Company has established "Methods for Companies Handling Personal Information to Receive Disclosure Requests" in accordance with Article 29-1 of the Personal Information Protection Law and Article 7 of its enforcement rules.
  2. Although an agent may request the notice of use objectives for personal information, the Company shall only send the Personal Information Use Objective Notice to the concerned individual. In addition, agents are legally limited to "Legal representatives consisting of legal guardians for minors or adults" and to "Agents entrusted by the concerned individual to request disclosure."
  3. There are instances where requests cannot be met due to the designations of Article 18-4 in the Personal Information Protection Law.
